Please read these rules (the “Official Rules”) before entering the Competition. By registering for the Competition, you agree to be bound by the Official Rules and represent that you satisfy all of the eligibility requirements set forth herein.
Code for Science – India (the “Competition”) is a skill-based online competition as announced on http://www.codeforscience.com/india (“Competition Site”) which invites participants to submit one or both of the following two sets of materials: (a) concept description (“Concept”) of an application as defined on Competition Site and/or (b) working application on the SciVerse platform (“Application”) using the SciVerse Content API (Application Programming Interface) and/or SciVerse Framework API (the “SciVerse APIs”) along with video demonstrating use case of the submitted Application. The Application shall be an XML-based definition file following OpenSocial specifications and may include data and functionality from applications hosted outside the SciVerse platform. The video must be under five-minutes long, have a voice over narration that demonstrates use case(s) of the submitted Application and accessible to view via visiting a web address.

AGREEMENT TO OFFICIAL RULES
By participating in the Competition, each participant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Primary Sponsor, which are final and binding in all matters related to the Competition. Winning a prize is contingent upon fulfilling all requirements set forth herein. Any participant found to be acting in violation of these Official Rules may be disqualified in Primary Sponsor’s sole discretion.
The Competition is open only to legal residents of India who are 18 years of age and above, and (1) who are students of an academic institution in India, or (2) members of corporations or organizations that are domiciled in India at the time of entry. Individuals submitting on behalf of teams, corporations and nonprofit organizations must meet the eligibility requirements for individual contestants. An individual may join and represent only one team, corporation or nonprofit organization. If a submission is being made by a team, each member of the team must read and agree to be bound by these official rules. Participants can compete in teams of one to four, provided each member of the team meets the eligibility criteria. All members of a team must have registered for the Competition at the Competition Site to be eligible. Entrants may be subject to rules imposed by their institution or employer relative to their participation in competitions and should check with their institution or employer for any relevant policies. Entrants are responsible for determining if the Competition is legal in their jurisdiction. VOID WHERE PROHIBITED OR RESTRICTED. Directors, officers, and employees of the Sponsor(s), its parents, subsidiaries and affiliates, and any participating vendors, professional advisors, advertising and promotional agencies, the Competition judges, and the immediate families and those living in the same household of the foregoing are not eligible to enter the Competition. Any Competition entry that violates these Official Rules, applicable laws or regulations, or entrant’s employer’s or institution’s policies will be deemed ineligible.
HOW TO ENTER
To enter the competition, participants must follow the instructions on the Competition Site and submit Concept through the Competition Site according to the Competition instructions between 12:01AM IST on May 05, 2012 and 11:59PM IST on May 25, 2012 (“Concept Stage”). A panel of judges will score the Concept entries based on judging criteria. The final scores will determine the winning Concept entries. All participants who submitted Concepts are hereby invited to move forward in the Competition to submit an Application. Participants who were not a part of the Concept Stage are also hereby invited to submit an Application.
Following Concept submission, participants may submit an Application which must be done through http://www.developers.elsevier.com/action/devprojects according to the submission instructions at http://www.developers.elsevier.com/cms/documentation and submit a maximum five-minutes demo video according to the Competition instructions between 12:01AM IST on June 06, 2012 and 11:59PM IST on July 15, 2012 (“Application Stage”). The Application entry may or may not follow the Concept entry previously submitted.
After you submit your Application and video demo entry, your Application will be locked and you will not be able to make any further changes. A panel of judges will score the Application entries based on judging criteria. The final scores will determine the winning Application entries.
Entries that are (i) submitted in any manner other than as specified; (ii) submitted before or after the Competition period; or (iii) incomplete, defective, forged, or irregular in any way or not in compliance with these Official Rules will be disqualified. Primary Sponsor’s servers and clock shall serve as the official clock for the Competition and participant’s proof of submission does not constitute proof of receipt by Primary Sponsor. Entry materials will not be acknowledged or returned.
ACCESS TO SCIVERSE CONTENT, PLATFORM AND APIS
Upon registering to start a SciVerse Application project on http://www.developers.elsevier.com/action/devprojects, registrants will receive a SciVerse ScienceDirect and SciVerse Scopus username and password via email, and instructions on how to obtain a SciVerse API Key. The SciVerse ScienceDirect and SciVerse Scopus username and password and SciVerse API Key are for use solely by the registered participant for purposes of the Competition and participants shall not disclose to or share these with anyone else for any reason. Use of the SciVerse platform and SciVerse APIs is subject to and shall comply with the SciVerse Application Developer Program Agreement at http://www.developers.elsevier.com/cms/developeragreement. The content in the SciVerse framework retrieved via the use of the SciVerse APIs shall be used solely for purposes of the Competition. Any changes in the process of receiving access to the SciVerse content and obtaining a SciVerse API Key for the Competition will be communicated on the Competition Site.
A Concept and Application submitted for consideration in the Competition must be the original work of and created solely by the participants. Modifying, enhancing, or altering a third‐party's pre‐existing work does not constitute an original work. A Concept and Application can include elements not owned by the participant (including, but not limited to Open Source Software, third‐party APIs), but will be judged on the original work.
INTELLECTUAL PROPERTY RIGHTS
A submitted Concept and Application shall not: (i) violate the intellectual property rights (copyright, patent, trademark, etc.) of any third party; (ii) defame or invade the publicity or privacy rights of any person, living or deceased; or (iii) otherwise infringe upon any person’s or entity’s personal or proprietary rights. Each participant must have a non-restricted right to submit the Concept and Application for consideration. Any participant whose Concept and/or Application includes elements not owned by the participant (including, but not limited to, third-party APIs, trademarks and logos) must be responsible for intellectual property right protection of such elements and be able to provide legal releases for such use in a form satisfactory to the Primary Sponsor or they will be disqualified. Concepts and Applications must not be obscene, profane, or unsuitable for publication in Primary Sponsor’s sole discretion.
Each Participant also agrees to grant the Primary Sponsor a royalty-free, non-exclusive, irrevocable, worldwide, perpetual license in and to the submitted Concept and/ or Application including but not limited to license to use, reproduce, distribute, publicly perform, publicly display, modify for purposes of publicly performing and publicly displaying the submitted Concept and/ or Application in connection with the Competition. For the avoidance of doubt, the Primary Sponsor may use all or any part of a submitted Concept and/ or Application for any purposes at its discretion, including, without limitation, using the Concept and/ or Application for promotional, marketing or publicity purposes in connection with the Competition. Each Participant further agrees to execute any and all documents necessary to effectuate such license.
USE OF CONCEPT AND APPLICATION INFORMATION
None of the entry materials and information submitted by participants will be treated as confidential, so please do not submit proprietary information. Participants further agree that personally identifiable information may be processed, stored, and otherwise used for the purposes of the Competition, including, but not limited to, checking participant’s identity, postal address, and telephone number, or to otherwise verify eligibility to participate.
The Competition Judges will comprise the panel of judges select by the Primary Sponsor. The Primary Sponsor may at their discretion reveal the names of the Competition Judges on the Competition Site. The constitution of the panel of the Competition Judges may change at the sole discretion of the Primary Sponsor.
All eligible entries will be screened by the Primary Sponsor with regard to obvious intellectual property conflicts or any legal issues or other obvious disqualifying factors. The eligibility and judging criteria will include considering the qualifying entry (“Qualifying Concept/ Application”) which entails:
- Whether the participant is eligible for the competition (according to Eligibility Criteria) provided under these Official Rules;
- Whether the Concept and/ or Application uses any third-party datasets/APIs for which the participant requires the rights to use the IP rights of such third parties and if the same has not been obtained, (as per the Intellectual Property section of these Official Rules) the said Concept and/ or Application will not qualify.
- Whether the Concept and/ or Application is an original work of the participant (according to Original Work section of these Official Rules.)
Qualifying Concept / Application entries will be scored by the panel of Competition Judges. The decisions of Competition Judges are final and binding. The Competition Judges will evaluate the entries based on but not limited to the following criteria:
- How novel is the Qualifying Concept/Application?
- Does the Qualifying Concept/Application use and integrate various data sources in an innovative way?
- How easy is it to understand and use the Qualifying Concept/Application?
- Is the functionality of the Qualifying Concept/Application obvious and intuitive?
- How well does the Qualifying Concept/Application address the problem(s) of target users which the team identified?
- Does the Qualifying Concept/Application add a clear value to the specific research discipline(s) other than workflow?

Participants of winning Application entries will be notified via e-mail or phone on July 26, 2012 and invited for CFS Talk event to be recognized as winners on July 29, 2012. Participants of winning Application entries must sign and return to Primary Sponsor a Declaration of Eligibility/Liability and Publicity Release (“Declaration and Release”) to be eligible to win prizes announced at the Awards Ceremony.
If a potential winner: (i) is determined to be ineligible for any reason; (ii) cannot be located or contacted, including but not limited to an e-mail notification returned as undeliverable; (iii) fails to return the completed Declaration and Release by the required time; or (iv) declines or cannot or fails to accept a prize for any reason, the prize will be forfeited and an alternate winner will be selected based on the judging criteria and notified according to the procedure above. Individual winners and, for team winners, at least one member of the winning team must remain present at the awards ceremony to receive their respective prizes.
Primary Sponsor reserves the right to select fewer or more winners than mentioned above if, in its sole discretion, Primary Sponsor does not receive a sufficient number of eligible or qualified entries, or if Primary Sponsor is unable to notify and retrieve signed Declarations and Releases from the winners prior to the awards. Limit one prize per entrant. Winners will be announced at the awards ceremony and the prizes will be awarded at that time. The prize for a winning team will be awarded to the individual signing the Declaration and Release on behalf of the team. Disposition of prizes is at the sole discretion of members of a winning team and Primary Sponsor will not be responsible or liable for any disputes which may arise among winning team members.
GENERAL PRIZE RESTRICTIONS
Prizes may not be transferred or assigned prior to award. No cash or other substitution may be made, except by the Primary Sponsor, who reserves the right to substitute a prize in whole or in part with another prize of comparable or greater value if the intended prize is not available for any reason as determined by the Primary Sponsor in its sole discretion. Winners will be responsible for all applicable taxes (not limited to federal, state, local and/or income) on the prize. Winners are solely responsible for any costs associated with use of the prize. Gift cards are subject to the terms and conditions generally applicable thereto.
RIGHT TO USE ENTRIES
By entering the Competition, participants grant Primary Sponsor and its affiliates, the rights, without limitation or further permission or compensation, to: (i) use and publish their name and likeness; and (ii) use, reproduce, publish, display and distribute the website URL to the Concept and/or Applications. Winners’ full names, and city and state/province of residence and their Applications will be announced and, with their photograph, may be featured on the Competition Site and websites of the Primary Sponsor and its affiliates. By accepting a prize, winners grant Primary Sponsor and its affiliates, the additional rights, without limitation or further permission or compensation, to use and publish their photograph in conjunction with their credited name. Rights granted by participants and winners are for advertising, publicity and promotional purposes in perpetuity and in any medium Primary Sponsor sees fit, including, but not limited to, website, television, radio, or printed materials, now known or later developed.
By submitting an entry, each participant grants Primary Sponsor and the judges a royalty-free irrevocable, perpetual and unrestricted right throughout the world to use, review, assess, test, reproduce, modify, distribute, commercialize, create derivative work of the entries and otherwise analyze the entries and all of their content, in whole or in part, which is submitted by the participant in connection with the Competition. Such right granted to the Primary Sponsor and the judges includes the right to sub-license to any third party. Notwithstanding the provisions of the Copyright Act, 1957, the rights granted herein shall not lapse if the same are not exercised by the Primary Sponsor or the judges, as the case may be, within the period of one year from the date hereof. The participant waives its rights to be identified as the author of all works which may be submitted in connection with the Competition.
Participants agree not to instigate, support, maintain or authorize any action, or lawsuit against the Primary Sponsor on the ground that any use of the entry materials infringes any of the participants’ rights as creators of the entry materials.
Participants acknowledge that Primary Sponsor may currently, or in the future, be developing internally, or receiving from a third-party, information or applications similar to those submitted by participants. Nothing contained in these Official Rules will be construed as a representation or agreement that Primary Sponsor will not develop or have developed products, concepts, systems, or techniques that are similar to or that compete with the products, concepts, systems, or techniques contemplated by or embodied in any of the entry materials. Further, Primary Sponsor shall be free to use for any purpose the residuals resulting from access to work with entries. The term ”residuals” means information in intangible form, which is retained in memory by persons who have had access to the Concepts and/ or Applications, including ideas, concepts, know-how, or techniques contained therein. Primary Sponsor shall have no obligation to limit or restrict the assignment of such persons or to pay royalties for any work resulting from the use of residuals.
DISCLAIMER/LIMITATION OF LIABILITY
Notwithstanding anything to the contrary contained in these Official Rules or elsewhere, Sponsor makes available the Competition, the Competition Site and any prizes on an ”as is” basis and disclaims all warranties, including warranties of merchantability and fitness for a particular purpose in connection therewith. Sponsor, and its parent, subsidiaries, affiliates, agents, professional advisors, advertising and promotional agencies, and directors, officers, and employees thereof, shall not have any obligation, liability or responsibility for: (i) lost, late, incomplete, illegible, unintelligible, damaged, garbled, or misdirected entries, prize claims or notifications; (ii) inaccurate entry information, whether caused by participant or by any of the equipment or programming associated with the Competition; (iii) any errors or malfunctions that may occur; (iv) any condition caused by events beyond Sponsor’s’ control that may cause the Competition to be delayed, disrupted or corrupted; (v) any error in any materials associated with the Competition; and (vi) any damages or losses of any kind resulting from participation in the Competition, accessing, transmitting, uploading or downloading data in connection with the Competition, or acceptance, possession or use of any prize.
BY ENTERING THE COMPETITION OR SUBMITTING A CONCEPT THROUGH THE COMPETITION SITE, PARTICIPANTS SHALL RELEASE AND HOLD HARMLESS SPONSOR AND IT’S PARENT, SUBSIDIARIES, AFFILIATES, AGENTS, PROFESSIONAL ADVISORS, ADVERTISING AND PROMOTIONAL AGENCIES, AND DIRECTORS, OFFICERS, AND EMPLOYEES THEREOF, FROM ANY AND ALL CLAIMS, INJURIES, LOSS, DAMAGE, EXPENSES, OR LIABILITIES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THE CHALLENGE, PARTICIPANTS’ PARTICIPATION IN THE CHALLENGE, OR DELIVERY, MISDELIVERY, ACCEPTANCE, POSSESSION, AND USE OF, OR INABILITY TO USE, ANY PRIZE, TO THE EXTENT PERMITTED BY LAW. IN NO EVENT WILL SPONSOR BE LIABLE TO A PARTICIPANT FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF, OR IN CONNECTION WITH THE CHALLENGE, WHETHER OR NOT SPONSOR HAS BEEN ADVISED, HAD REASON TO KNOW, OR IN FACT KNEW OF THE POSSIBILITY OF SUCH DAMAGE TO THE EXTENT PERMITTED BY LAW.
GOVERNING LAW AND VENUE
The laws of the Republic of India govern the Competition and these Official Rules without reference to choice of law principles. The Competition is subject to all applicable federal, state and local laws and regulations. Participants hereby irrevocably consent to the exclusive jurisdiction of the courts of Republic of India with respect to any action or suit arising out of or pertaining to the Competition and these Official Rules (except where local law requires). All disputes between the participants and the Sponsor and/ or the judges shall be finally settled by and in accordance with the Arbitration and Conciliation Act, 1996.
RESERVATION OF RIGHTS
If for any reason, the Competition is not capable of being run as planned, the Primary Sponsor reserves the right in its sole discretion to change these Official Rules, disqualify any individual who tampers with the entry process or operation of the Competition Site, and to modify, suspend, cancel or terminate the Competition. If the Competition is terminated early, the Primary Sponsor may select winners based on the entries received prior to the termination date, or take any other action in its sole discretion to carry out the latter and spirit of these Official Rules.
By submitting an entry, participants represent that they meet all requirements for eligibility and agree to be bound by these Official Rules and the decisions of the Primary Sponsor in regards to the Competition. Any participant found to be acting in violation of these Official Rules may be disqualified in Primary Sponsor’s sole discretion. In the event of a dispute regarding the identity of any entrant, the entry will be declared made by the license holder of the Concept and/ or Application submitted.
